What does the SEN Code of Practice say?

9.80 in the Code of Practice states that:

The local authority must consult the governing body, principal or proprietor of the school or college concerned and consider their comments very carefully before deciding whether to name it in the child or young person’s EHC plan, sending the school or college a copy of the draft plan. If another local authority maintains the school, they too must be consulted.

 

9.83 makes clear that schools have 15 days to respond to the consultation.

We will produce a letter to the local authority that responds to the following questions:

  • Is the setting appropriate to the child / young person’s age, ability, aptitude or special educational needs?
  • Would the child / young person’s attendance be compatible with the efficient education of the other pupils with whom they would be educated?
  • Would the child / young person’s attendance impact on your setting’s efficient use of resources?
  • What reasonable adjustments can be made to meet the needs of the child / young person?

We will use your school’s SEN Information Report, the draft EHCP, the provision map that you have for the school and, if it is necessary, a 30 minute Teams meeting in order to clarify arrangements in your setting.  We will consult with the MIS information to obtain detail about class sizes and teacher:pupil ratios.
